OF SALE OF PET PUPPIES

This
purebred Golden Retriever puppy is, at time of sale, a healthy, happy puppy of sound
temperament. S/he is the result of selective mating of parents
with certified hip and eye clearances and heart examination and is an
excellent representative of the breed. All REBELCREEK puppies are
sold on a complete health and satisfaction guarantee. Your puppy
has had a complete and thorough examination by our Veterinarian at the
age of 7 to 7-1/2 weeks and is guaranteed to be in a good, clean state
of health on departure from our kennel. You are advised to have
your Veterinarian examine your new puppy within 72 hours of departure
from our kennel. If for any reason the purchaser is not satisfied
with the puppy within the 72 hour period, s/he may return it to our
kennel at his/her expense, provided the puppy is in the same condition
as when sold. The purchaser will receive a replacement puppy from
the next available litter or a full refund as decided upon by the
breeder. All veterinary costs after departure from our kennel, no
matter what the reason, and including the 72-hour period, are the
responsibility of the buyer.
THE BREEDER PROVIDES THE FOLLOWING
TWO YEAR WARRANTY on each pet puppy sold:

Free of hip dysplasia as certified by O.V.C. or O.F.A.
THE BREEDER
DOES NOT WARRANTY THE FOLLOWING on any
puppy sold:
1.
Osteochondritis Dissecans (OCD) If
your puppy is severely crippled by any of the guaranteed conditions and
if contract conditions have been adhered to and suitable evidence is
produced, the puppy may be returned to the breeder in good clean
condition at the buyer's expense with the Registration papers signed
over to the breeder. A puppy of the same sex and quality,
selected by the breeder, will be guaranteed to the buyer from another
litter, though not necessarily from the same bitch nor from the next
litter due to arrive. The breeder reserves the right to refund
the purchaser his original price of the puppy should the breeder decide
not to place another puppy with the purchaser. Alternatively,
where the purchaser chooses to keep the said dog, the breeder shall, at
the option of the breeder, and upon proof of spay/neuter, reimburse the
purchaser an amount determined by the breeder in line with the
condition and it's effects on the dog's life. In any case, this
amount shall not exceed, in total and in combination for all
conditions, a lifetime maximum of one half the purchase price of the
puppy. The breeder may request that the purchaser obtain further
opinions in the case of x-rays, eye and/or heart examinations.
Obtaining additional opinions will be the responsibility of the
purchaser. The breeder may request to have any reports or x-rays
mailed or shipped to the breeder's veterinarian. Under no
circumstances will THE BREEDER be responsible for the cost
of any veterinarian bills for any reason whatsoever, nor will THE BREEDER be responsible for the cost of surgery for any reason
whatsoever. 1.
The buyer will take good care of the dog, providing quality nutrition,
shelter and medical care, including

The buyer agrees to feed a quality Puppy Food and at the appropriate
age (as advised by your vet) to switch
3.
The buyer agrees to provide daily exercise and to neither overwork nor
underwork the dog, and will not allow
4.
The buyer undertakes to ensure the puppy receives obedience training,
preferably through a recognized training school.
5.
The buyer agrees the dog shall never be used for experimental or
research purposes.
6.
The buyer agrees that dog shall be kept well groomed.
7.
The buyer agrees to contact the breeder should the buyer need to part
with this dog for whatever reason.
8.
The buyer agrees to contact the breeder at all times when the dog has
been seen by a Veterinarian for any PUPPIES THAT ARE REARED CONTRARY TO ANY OF THE
AFOREMENTIONED CONDITIONS ARE MORE SUSCEPTIBLE TO HEALTH PROBLEMS,
COMPROMISED SOUNDNESS, LACK OF CLEARANCES, OR ARE POTENTIALLY OF POORER
QUALITY THAN THEY HAD THE POTENTIAL AS A PUPPY TO BE; AS SUCH, FAILURE
TO COMPLY WITH THE ABOVE EIGHT CONDITIONS WILL RENDER THE GUARANTEE
NULL AND VOID. Puppies
sold on an Agreement of Sale of Pet Puppies shall be spayed/neutered by
the Purchasers before the dog attains nine (9) months of age.
Puppies leaving Rebelcreek Kennel do so on a Non-Breeding
Agreement. Under some conditions a puppy may not be registered
with a C.K.C. Non-Breeding Agreement. In this case, this
Agreement of Sale forms a Non-Breeding agreement and the purchaser is
bound by the Non-Breeding clauses of this contract, wherein the buyer
agrees not to use this dog for breeding pending meeting the conditions
as set out herein. Both the C.K.C. Non-Breeding Agreement and the
Non-Breeding Agreement inherent in this Agreement of Sale will not be
removed unless the following conditions are met:
1.
Free of hip dysplasia as certified by O.V.C. or O.F.A.
2.
Free of hereditary eye disease as certified by a canine ophthalmologist
3.
Free of Sub-Aortic Stenosis (S.A.S.) as certified by a board certified
canine cardiologist
4.
Free of any disqualifying features as set out by the Golden Retriever
Breed Standard
5.
To be of sound
temperament and a good representative of the breed
6.
To complete a CKC or
AKC conformation championship, CKC or AKC obedience title
or CKC/AKC field title in the country
7.
Payment is made to the
breeder for costs levied by the C.K.C. for cancellation of the
non-breeding agreement
8.
The non-breeding
agreement shall not be lifted before two years of age on females and
eighteen months for males.
9.
The purchaser shall
agree to make themselves knowledgeable of the process of breeding,
pregnancy, whelping, and

The breeder shall receive pick puppy from the first OR second litter

Payment is made to the breeder to upgrade to a show/breeding

In the event that this dog, which is sold as a pet, is used for breeding
and
where
written permission of the Breeder is not given to breed the said dog, the
breeder shall be entitled to and shall receive from the buyer, liquidated
damages in the sum of $10,000.00 and this amount shall be binding upon the
said buyer. Liquidates damages shall be payable on written demand by
the BREEDER. It is
understood and agreed to by the parties to this agreement that this
agreement and the purchase and sale of the said dog shall fall under
the jurisdiction of the laws of the Town of Pontypool, City of Kawartha Lakes, Province of
Ontario and that any matters with respect to this Agreement shall be
dealt with as per the laws governing this location. It is further
understood that any circumstances/situations/disputes arising which are
not covered within this Agreement shall be remedied at the discretion
of the breeder and the breeder's decision shall be final and binding.
By signing this Agreement of Sale, the buyer
acknowledges having read this Agreement in its entirety and agrees to
all terms and conditions within this agreement. This agreement is
